Cryptocurrency Industry Celebrates Victory as Judge Upholds Decision on XRP and Binance vs. SEC Case

In a groundbreaking ruling that has sent shockwaves through the cryptocurrency industry, Judge Amy Berman Jackson has upheld Judge Analisa Torres’ decision regarding the XRP in the case involving Binance and the US Securities and Exchange Commission (SEC).

The ruling in the Binance vs. SEC case reaffirms Judge Torres’ landmark decision that XRP, the cryptocurrency native to Ripple, is not a security. Furthermore, the court determined that programmatic and secondary sales of the token do not meet the criteria for investment contracts under the Howey Test.

This victory for Binance marks a significant win against the SEC, as the court ruled that secondary market sales of BNB do not constitute securities. However, the company still faces charges for failing to clarify its arguments to Judge Jackson. Despite this, the decision rejected accusations of secondary sales of XRP, citing a previous ruling related to Ripple in June 2023.

Pro-XRP lawyer Bill Morgan praised the decision, calling it a positive development for XRP holders and the broader cryptocurrency community. She highlighted Judge Jackson’s preference for Judge Torres’ approach in differentiating between institutional investors and retail programmatic buyers, contrasting it with a different approach taken in a previous case.
